The South Dakota Trust Association is hosting its sixth annual Fall Forum on October 6 & October 7, 2022 at Sioux Falls Convention Center. The Fall Forum will include a variety of speakers on both the local and national level addressing a wide range of topics relating to South Dakota and the broader trust industry.
I will be a panelist on the “Regulatory Oversight of Fiduciary Services for Hire: Up to Snuff Or Not Enough?” panel. We have a great line up on the panel:
Bret Afdahl - Director of the South Dakota Division of Banking
Pat Goetzinger - Partner with Gunderson, Palmer, Nelson & Ashmore, LLP
Tom Simmons - Professor at the University of South Dakota Knudson School of Law
Elizabeth McMorrow – Owner Elizabeth A McMorrow Law LLC
The panel will discuss the KYC/AML and due diligence conducted by a trust company before accepting a trust. Professor Simmons is spearheading a comparative analysis of the topic among top trust jurisdictions for a law review article he is authoring. The panel is intended to illustrate the best practices and high level of scrutiny each trust company client undergoes before a trust is accepted by the company. The panel is also intended to rebut the incorrect impression left by Pandora Paper articles about the process. It will show South Dakota’s guardrails to keep bad actors out of South Dakota.
